Terms of Service

These Terms of Service apply to contracts concluded through eminovee.global with EMINOVÈE Trading GmbH, Teltower Damm 57, 14167 Berlin, Germany (“EMINOVÈE”, “we”, “us”). Mandatory consumer law always takes priority. Individually agreed terms take priority over these Terms.

Scope

The online store is intended for consumers and, where expressly indicated, business customers. Separate written terms can apply to B2B transactions. You must have legal capacity to place an order or act with the consent of a legal representative.

Products and pre-contract information

The essential characteristics, total price, taxes, delivery charges, delivery period, product identity and safety information, and any lawful restrictions or exceptions are displayed on the relevant product page and during checkout. Images illustrate the product; legally relevant specifications are stated in the product description. A product must not be ordered if required information or a delivery option is absent.

Order process and contract formation

You can review and correct your cart and checkout information before selecting the final order button. By selecting that button, you submit a binding offer to purchase the items in the order. An automated receipt message confirms that we received the order but is not an acceptance unless it expressly says so. We accept your offer by sending an express order acceptance or dispatch confirmation, or by dispatching the goods, within five days, whichever occurs first. If we do not accept, any payment already collected will be returned without undue delay.

The contract language is English unless another language is offered at checkout. Your order information and these Terms are provided or made available on a durable medium; please retain the order confirmation.

Prices and payment

The total price, including applicable taxes and charges, is shown before you submit the order. Available payment methods and any method-specific conditions are displayed at checkout. Payment processing can be provided by Shopify or another disclosed payment provider.

Delivery

Delivery destinations, methods, charges, and periods are governed by the information shown before ordering and by our Shipping Policy. We may use vetted service providers for fulfillment and transport, but EMINOVÈE remains your contractual seller.

Retention of title

Goods remain our property until the purchase price has been paid in full, to the extent permitted by applicable law.

Withdrawal, returns, and refunds

Consumers may have a statutory right of withdrawal. The conditions, process, electronic withdrawal function, model form, return costs, and exceptions are explained in our Returns & Refunds Policy. Statutory rights for defective or non-conforming goods are independent of withdrawal rights.

Conformity and liability

Statutory conformity, warranty, product-safety, and liability rules apply. Nothing in these Terms excludes or limits liability or a remedy where exclusion or limitation is not permitted by law.

Intellectual property and acceptable use

Store content, branding, text, graphics, and imagery may be protected by intellectual-property law. You may use the store for personal shopping and lawful business enquiries. You must not misuse the store, interfere with its security, or use content beyond what applicable law permits without authorization.

Changes to these Terms

The version presented when you place an order governs that order. We may update these Terms prospectively for legal or operational reasons; changes do not retroactively alter an existing contract.

Applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another country, this choice does not deprive you of mandatory protection granted by the law of that country. Statutory rules determine jurisdiction.
